The quick version of this terrible story is that Norman and Oriane Rousseau of Newbury Park, California were scammed into a predatory mortgage. But they made their payments anyway, always paying with a cashier’s check in person at the same branch. Then one day the bank misapplied their payment and said they still owed the money. This started a long, nasty process that led to the bank evicting the Rousseaus from their home.

Here’s the shocker: right at the start the Rousseaus came up with proof that the bank had received the payment and had cashed the check. But the bank continued to claim it had missed the payment, gave the Rousseaus the runaround, started applying fees, and used it as an excuse to foreclose on the house anyway.

The Rousseaus fought back, the bank dragged it out for so long and pulled so many tricks, getting its way every step of the process, until this last Sunday Norman Rousseau finally gave up and shot himself in despair – two days before the scheduled eviction, Tuesday, May 15. (The Rousseau’s lawyer just said he was able to win a 2-week delay.)

The banksters got away with this, in spite of the rules and documentation that said the bank was wrong. This is not a David vs. Goliath story, it's Bambi vs. Godzilla. Another reason why rules on mortgage lending need to be more stringent and enforced.

I can't begin to imagine the frustration this couple faced trying to get a mega bank to own up to a simple mistake and admit the mortgage money was paid.
So sad that it ended this way. I wish the bank could be charged with murder.

The deck is stacked against individuals. It sounds like every experience I've had with a large bank or corporation that made some "mistake" that cost me money. No one is ever responsible for anything. Certainly not whatever outsourced customer service person you get on the phone. Realistically, there's recourse for people getting screwed by a mega-bank unless they have the money to hire a lawyer, and sometimes not even then.

We need to make the term "Mega Bank"
dissapear from the U.S. It is long past due to break these banks up prosecute those that have violated the law by delaying processes.

Wells Fargo seems to primarily be run by psychopaths. Every time you turn around, there is another story illustrating how rotten to the core they are. They're horrible. This is also illustrative of why we need an up-and-working Consumer Financial Protection Bureau.

Have you been through a foreclosure? There are layers upon layers of bureacracy, you CANNOT get to a person who can make a decision. If you haven't gone through it personally, you have no idea. There is no way to get anything done, I don't care who you are. I would think you would have to have enough money to fly to Texas, kick in the door yourself with paperwork in hand, and be able to afford bail and an attorney to get you off the breaking and entering charge.

Wells Fargo is arguably the worst of the worst. There is no end to the horror stories I've heard of this place. One friend just sought to add his information to his mom's "contact just in case" account, and they practically wanted his life's dossier including tax and credit records. You have to be joking.

Yep. Sounds familiar. This is what they're doing. Oregon passed a law that they cannot proceed with foreclosure and modification at the same time, AND they MUST sit down face to face with the modification people. Too late for my daughter, I would have kicked someone's ass, but it will help an awful lot of other people.

Sadly, there are still waaaay too many people in this country who continue to put all the blame on the borrower. I don't get what is in it for them to deny reality and choose big banks over their neighbor.

It is so sad to read about the Rousseau that ended in the suicide of the husband, Norman Rousseau. I read that court documents which read like a horror show!! This injustice happened over a period of 5 years, starting in 2007.

The treatment of the Rousseau by Wells Fargo is a prime example of how powerless the individual is against a corporation, especially one that has trillions of dollars in assets and cash. The only means the individual have in fighting is the law and our legal systems..if that get sold out, then it is the end of America as we know it.

These mega banks and "too big to fail" institutions MUST be broken up..they are really so big that they act like mini countries unto themselves with no regard or loyality to the US and the laws of the land. They are practicing racketeering and there's little if anything that's being done to stop them!! Thank God for the Attorney Generals who are truly for the people taking a REAL stand to say enough is enough! And thank God to the corporations who have a social conscious and are truly helping the average Ameican.

There should be criminal charges brought against Wells Fargo and those individual employees who knowingly and intensionally participated in this injustice. They need to serve jail time. Now the employee may holla' "I am just following orders and doing my job..." but participating in an illegal act is no excuse for not going to jail...after all there is such a thing as accessory to murder! There should be a "hotline" set up with law enforcement so that an employee can anonymously call in and whistle blow..such an act would give them immunity from prosecution.

Corporations are made up of employees and consumers...we start from the bottom to get to the top!
