Indiana Governor Signs Bill Allowing Citizens To Use Deadly Force Against Police Officers Into Law

Republican Governor Mitch Daniels has signed Senate Enrolled Act 1 into law in Indiana. The new law allows citizens to use deadly force against police officers they think are illegally entering their homes. Earlier this month, Addicting Inforeported that the bill had passed the Senate. Republicans say the bill is designed to keep police safe, but Democrats say the bill will lead to the wanton killing of police officers.

Rep. Craig Fry, a Democrat, says the bill “is going to cause people to die and it’s too late after somebody dies for a jury to sort it out. Somebody’s going to die, whether it’s a police officer or an individual who thinks a police officer is entering their home unlawfully. People are going to die.”

<..> The new law reverses a state Supreme Court ruling that homeowners do not have the right to use force against law enforcement officials who they believe are illegally entering their homes. According to the Evansville Courier Press, an Evansville resident fought a police officer who followed him into his house during a domestic dispute call. “The state Supreme Court found that officers sometimes enter homes without warrants for reasons protected by the law, such as pursuing suspects or preventing the destruction of evidence. In these situations, we find it unwise to allow a homeowner to adjudge the legality of police conduct in the heat of the moment,” the court said. “As we decline to recognize a right to resist unlawful police entry into a home, we decline to recognize a right to batter a police officer as a part of that resistance.”

The NRA and its followers want a Wild West situation where they protect themselves. They don't believe in police protection and are attempting to codify that.

The fact that they are enabling drug dealers seems not to be a problem to them.

I think it's really important to correct them from a "law and order" perspective. Especially as the Martin case has brought up a lot of the things they talk about.

1. The NRA types often advance the argument that you're on your own until the police arrive. In the Martin case, even if Zimmerman felt threatened by Martin, the police arrived in 4 minutes after the dispatcher told him they were coming. Couldn't he have held out by avoiding Martin for 4 minutes?

2. The right wing has made a big deal out of "where is the black community concern for black on black violence?" Both the Stand Your Ground and Indiana laws make it awfully difficult for the community, any community--when the police can't arrest the bad guys.

I would refute their argument about "black on black" crime and say "what about the white on white crime", parents starving their children, husbands killing their wives on their honeymoon, here in WA state father who killed mother in another state, kills his boys and then himself. (They conveniently ignore these horrific statistics)

How in God's name is signing a bill that allows people to murder police officers keeping police officers "safe." This is sick. And to think, Daniels is considered to be one of the "smart" ones.

Perhaps this will encourage the police to be extra sure whose door they are kicking in and sure about indentifying themselves as peace officers during that process. Perhaps it would even eliminate what are surely many arrest warrants needlessly being served SWAT style. (but it looks so cool when they do that on COPS)

Hmmm this is not going to end well
another bad decision by a Repug governer.

This is dangerous for all around.

I believe the police have a responsibility to double check addresses and suspects before they kick down a door. It seems like a no brainer to me but we have seen too many instances where innocent victims homes were invaded only to find out the address was wrong.

This is insanity.

If a homeowner attempts to defend themselves against a wrong address door kick in many end up dead.

If cops were to obey the rights of people given under the constitution and not some BS law passed that violates even the Magna Carta then they have nothing to worry about. But as history shows us. So called peace officers were always militarized and used to oppress the people violently. This is happening in a ever increasing number today. If you don't know what I am talking about open your eyes. Cops have there place but they need to remember who they work for and what they serve. Violations to the constitution means your a traitor. Every service member, or public servant is sworn to it. Yet they all walk around like they are above it and treat people like crap. Traffic tickets are a example of tyranny. Around 70 percent of Indiana police are traffic cops. Yah I feel safe! They need to start obeying the public rights and the public need to start realizing they are the power not some wannabe tough guy with a badge.
