Saggy pants arrest: football player Deshon Marman's arrest on a US Airways flight for wearing saggy pants drew criticism, and accusations of racism. Prosecutors, Wednesday, agreed that criminal charges were not warranted.

Prosecutors said Wednesday they will not file charges against a University of New Mexico football player who was arrested after wearing saggy pants on a plane at San Francisco airport.

"My belief is if we took this into a courtroom with 12 members of our community on our jury, they would tell me, 'Come on guys, you have more important things to spend your time on,'" District Attorney Steve Wagstaffe said. "And I share that view."

The incident sparked allegations of racial profiling after a photo surfaced of a man who flew aboard a US Airways flight wearing skimpy women's panties and mid-thigh stockings days before Marman's arrest. That man was white. Marman is African-American.

Marman plans to file a lawsuit against US Airways alleging he was the victim of racial profiling, O'Sullivan said.

I definitely think it was racial profiling. While I am sorely tempted to yank those low-flying pants down (bwahahahahaha!), I hardly think it's an arrestable offense.

Glad they declined to prosecute!

i agree with you, SeattleGirl: racial profiling, absolutely; i, too, often feel tempted to yank those pants "(bwahahahahaha!)"; and it definitely isn't an arrestable offense - especially if that jerk dressed in underwear's getup wasn't arrestable, not to mention some things we see people wearing these days!

I knew this was gong to happen. Now I hope the young man sues the airline for huge sums of money.

Glad to hear someone still has a little sense. Good for the DA. And yes, sue the airline!

Read the other day that some town in Illinois passes a law about no pants below the belt line and no undies showing......or else!!! If the young folks are smart they will get a lawyer on this before they are arrested. I don't think people can tell others how to dress.
